What Gets Contested in a Houston Divorce

A contested divorce arises when spouses disagree on at least one material issue and can’t resolve it without court involvement. Those disputes take many forms. We handle contested matters involving the division of community property and debt, conservatorship (legal decision-making authority over children), possession and access schedules, child support amounts, and spousal maintenance.

Some cases become contested because one spouse refuses to participate in good faith. Others involve suspected asset concealment, significant property tied up in business interests, or a level of conflict that makes negotiated settlement impractical. Fault grounds such as adultery, cruelty, or abandonment can be raised in Texas and may affect how the court divides property. Contested divorce in Texas moves through several procedural stages, and each one carries consequences for the next. One spouse files an original petition. The other must be properly served and may respond or file a counter-petition. Texas law requires a minimum 60-day waiting period before a divorce can be finalized.

Texas Requirements for Filing a Contested Divorce

To file for divorce in Texas, at least one spouse must have been a Texas resident for at least six months and a resident of the county where the divorce is filed for at least 90 days. For most Houston divorces, that means filing in Harris County after meeting both thresholds.

Texas allows both fault and no-fault grounds. The no-fault ground is insupportability, meaning the marriage has become insupportable due to conflict or discord with no reasonable expectation of reconciliation. Fault grounds include adultery, cruelty, abandonment, and felony conviction. Proving fault isn’t required to obtain a divorce, but if fault grounds are established, they can influence how the court divides community property.

Texas is a community property state. Property and debts acquired during the marriage are generally treated as community property subject to just and right division by the court, which doesn’t require an equal split. Separate property acquired before the marriage or received as an inheritance or gift is generally not subject to division, though tracing and characterizing separate property can itself become a contested issue.

Contested vs. Uncontested Divorce in Texas

In an uncontested divorce, both spouses agree on all material issues before or shortly after filing, and the case moves through the court with minimal hearings. A contested divorce involves at least one issue the parties can’t resolve by agreement, requiring a judge to decide it.

Contested divorces involve more hearings, more time, and typically higher costs. Discovery, temporary orders hearings, and the possibility of trial all extend the timeline and the legal work required. That said, many contested divorces in Texas still resolve before a final trial through negotiation or mediation, and a case that begins contested can settle at any point in the process.

Even when settlement is the likely outcome, thorough preparation for trial matters. The strength of a party’s position at the courthouse directly affects the quality of any negotiated result.

Mediation in a Texas Contested Divorce

Mediation is a structured process in which a neutral third party works with both spouses and their attorneys to help them reach agreement on disputed issues without going to trial. The mediator doesn’t decide anything. Their role is to facilitate negotiation, not to rule.

Harris County courts commonly require mediation before scheduling a final divorce trial. The parties typically attend with their attorneys and are kept in separate rooms while the mediator moves between them. If the parties reach agreement, those terms are formalized and submitted to the court, potentially resolving the case without a trial. Mediation can produce arrangements on conservatorship schedules, property division, and support terms that a judge might not specifically order.

If mediation doesn’t produce a full settlement, the case proceeds to trial on whatever issues remain unresolved. Because a prepared position can strengthen negotiations at both mediation and trial, the work done in advance is never wasted, regardless of how the session ends.
