What Federal Law Says about Grandparents' Rights.

In a recent decision, the U.S. Supreme Court declared that grandparents do not automatically get visitation rights with their grandchildren following a child custody ruling. In fact, the ruling declared that individual state law granting automatic grandparent visitation rights was in violation of the U.S. Constitution.

But the Supreme Court also left room for states like Texas to take special circumstances into account. Concerns such as the child's physical and emotional welfare are open to consideration. Texas family courts are willing to consider the impact on a child whose parents are proven incapable of protecting the best interests of the child. In short, when it is the right thing for grandparents to get involved in their grandchild's life, the law provides opportunity.
